These Terms of Use (“Terms”) govern access to and use of NicoleIvy.com, the Nicole Ivy online store, and related digital services (collectively, the “Site”). The Site is operated by Nicole Ivy LLC (“Nicole Ivy,” “we,” “us,” or “our”).
By accessing or using the Site, creating an account, joining a list, or placing an order, you agree to these Terms and to our Privacy Policy and other policies referenced on the Site.
If you do not agree to these Terms, please do not use the Site.
Nicole Ivy is an independent luxury house offering tableware, decorative objects, and related lifestyle goods.
Product availability, quantities, materials, finishes, dimensions, pricing, delivery estimates, and other product information are described on the applicable product page and may be updated before an order is placed.
Nicole Ivy is an independent brand.
Unless Nicole Ivy expressly states otherwise on a specific product page or in an official written announcement, Nicole Ivy and its products, collections, designs, marketing materials, and services are not sponsored by, endorsed by, affiliated with, authorized by, or licensed by any third-party person or organization.
The appearance of a design element, color, word, botanical motif, decorative motif, or other aesthetic element should not be interpreted as representing an affiliation, endorsement, sponsorship, authorization, or licensing relationship with any third party unless Nicole Ivy expressly identifies such a relationship.
Any third-party trademark, name, or other intellectual property that may be referenced for legitimate informational purposes remains the property of its respective owner.
The Site and its original content, including photographs, written copy, graphics, illustrations, product photography, original artwork, layouts, packaging concepts, product presentations, videos, and other creative materials, are owned by or licensed to Nicole Ivy and may be protected by copyright, trademark, trade dress, design, and other applicable intellectual-property laws.
The NICOLE IVY name, Nicole Ivy wordmark, NI monogram, Nicole Ivy logos, original brand artwork used as source identifiers, taglines, and other protectable brand indicia are or may be trademarks of Nicole Ivy LLC.
Nothing in these Terms should be interpreted as claiming ownership of intellectual property belonging to another person or entity or as claiming exclusive rights in elements that are not protectable under applicable law.
You may access the Site for personal, non-commercial purposes. You may not reproduce, publish, distribute, modify, commercially exploit, imitate, or create derivative commercial materials from Nicole Ivy intellectual property without prior written authorization.
Certain Nicole Ivy products are released in limited quantities.
When a product is identified as a numbered edition, the edition quantity refers to the number of sets or individual articles expressly identified on the relevant product page.
Once a limited edition has been fully allocated, Nicole Ivy may retire that edition permanently.
Nicole Ivy reserves the right to limit quantities, discontinue products, reject or cancel orders, correct errors, or modify future product offerings.
Nothing in these Terms requires Nicole Ivy to reproduce, restock, or reissue a discontinued or sold-out product.
Nicole Ivy makes reasonable efforts to present product colors, proportions, finishes, materials, and details accurately.
Because products may incorporate hand-applied, hand-finished, kiln-fired, decorated, or other production processes, minor variations may occur between individual pieces. Such variations may be characteristic of the applicable production process and do not necessarily constitute a defect.
Screen settings, lighting, photography, and device characteristics may also affect how colors and finishes appear online.
Specific product materials, manufacturing techniques, dimensions, and care requirements are described on the applicable product page or accompanying product materials.
Prices are displayed in U.S. dollars unless otherwise stated.
Taxes, shipping charges, customs duties, import charges, and similar costs may be added where applicable.
Nicole Ivy may correct pricing or typographical errors before fulfilling an order. If an order is cancelled because of an incorrect price and payment has already been collected, the amount collected for the cancelled merchandise will be refunded.
Customers represent that they are authorized to use the payment method provided.
Submitting an order does not guarantee acceptance.
Nicole Ivy may decline or cancel an order for legitimate reasons, including suspected fraud, payment problems, pricing or inventory errors, violation of purchase limits, or inability to fulfill the order.
If Nicole Ivy cancels an order after payment has been collected, amounts paid for cancelled merchandise will be refunded as required by applicable law.
Shipment and delivery dates are estimates unless Nicole Ivy expressly states otherwise.
Nicole Ivy will make reasonable efforts to ship merchandise within the timeframe represented at the time of purchase.
If Nicole Ivy becomes unable to ship an order within the promised timeframe, we will provide any notice, cancellation opportunity, consent request, or refund required by applicable law.
Nothing in our Final Sale policy eliminates any cancellation or refund right that applicable law gives a customer because Nicole Ivy is unable to ship merchandise within the represented timeframe.
Nicole Ivy's current Returns Policy forms part of these Terms.
Unless otherwise required by applicable law, products identified as Final Sale may not be returned solely because of a change of mind after shipment.
Final Sale status does not eliminate rights relating to merchandise that arrives damaged, is materially defective, is materially different from what was ordered, or must otherwise be refunded or replaced under applicable law.
A Nicole Ivy Certificate of Authenticity may accompany designated limited-edition merchandise.
Certificates, edition numbers, packaging, markings, or other authentication features remain subject to Nicole Ivy's authentication records.
Possession of packaging, a certificate, photograph, serial number, or similar material by itself does not establish authenticity if that material has been copied, altered, separated from the original product, or otherwise misused.
If you voluntarily submit a review, photograph, comment, testimonial, or other content to Nicole Ivy, you represent that you have the right to provide it and that doing so does not violate another person's rights.
Unless otherwise agreed in writing, you grant Nicole Ivy a non-exclusive, worldwide, royalty-free license to reproduce and display voluntarily submitted content in connection with Nicole Ivy's business, marketing, customer service, and Site operations.
Nicole Ivy is not required to publish submitted content and may remove content from Nicole Ivy-controlled platforms at its discretion.
The Site may use or link to services operated by third parties, including payment processors, shipping companies, social platforms, analytics providers, and other service providers.
Nicole Ivy does not control third-party websites and is not responsible for their independent content or privacy practices.
A link does not, by itself, represent an endorsement, partnership, affiliation, or sponsorship.
To the fullest extent permitted by law, the Site is provided on an “as is” and “as available” basis.
Nicole Ivy does not warrant that the Site will always be uninterrupted, error-free, or free from harmful components.
Nothing in these Terms excludes any warranty, guarantee, consumer protection, or other right that applicable law does not permit Nicole Ivy to exclude.
To the fullest extent permitted by applicable law, Nicole Ivy LLC and its officers, employees, representatives, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising solely from use of the Site.
Nothing in these Terms limits liability that cannot legally be limited or excluded.
These Terms are governed by the laws of the State of Alabama and applicable federal law, without regard to conflict-of-law principles, except where another jurisdiction's mandatory consumer-protection laws apply and cannot lawfully be waived.
Unless applicable law requires otherwise, disputes not resolved informally will be subject to the jurisdiction of the appropriate state or federal courts serving Alabama.
Failure by Nicole Ivy to enforce a provision of these Terms on one occasion does not waive the right to enforce that provision later.
If any portion of these Terms is found unenforceable, that portion will be limited or severed to the minimum extent necessary, and the remaining provisions will continue in effect.

Legal correspondence intended to provide formal notice to Nicole Ivy LLC should clearly identify the sender, the matter involved, and appropriate return contact information.
